Terms and Conditions
Welcome to Nyte. By accessing or using the Nyte website, app, or services ("Platform"), you agree to these Terms and Conditions. If you do not agree, please do not use the Platform.
1. About Nyte
Nyte is a nightlife discovery and social platform that allows users to explore venues, events, live activity, and social experiences in real time. Nyte may include user-generated content, venue information, maps, reviews, check-ins, messaging features, and event-related content.
2. Eligibility
You must be at least 18 years old to use Nyte. By using the Platform, you confirm that you are legally permitted to use the Platform in your jurisdiction, that any information you provide is accurate and current, and that you will comply with all applicable laws and regulations.
3. User Accounts
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials, all activity conducted through your account, and ensuring your information remains accurate and up to date. Nyte may suspend or terminate accounts that violate these Terms.
4. User Conduct
You agree not to post illegal, abusive, defamatory, hateful, threatening, harmful, misleading, or false venue, event, or activity information; harass, stalk, or impersonate other users; upload malicious code; use the Platform for unlawful activities; attempt unauthorised access; or collect or misuse other users' personal information. Nyte may remove content or restrict access at its discretion.
5. Location Services
Certain features may require access to your location. By enabling location services, you consent to Nyte collecting and using location data to provide venue discovery, nearby activity, live maps, and social or event-based recommendations. You may disable location permissions through your device settings, although some features may not function correctly.
6. User Content
You retain ownership of content you upload or post to Nyte, including photos, videos, comments, and profile information. By posting content, you grant Nyte a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, modify, and distribute that content for operating, improving, and promoting the Platform. You are solely responsible for content you post.
7. Venue and Event Information
Nyte does not guarantee the accuracy of venue operating hours, crowd levels, event details, promotions, pricing, or availability. Information displayed on the Platform may change without notice. Users should independently verify venue and event details where necessary.
8. Safety and Personal Responsibility
Nyte is a discovery platform only. Nyte is not responsible for user interactions, behaviour at venues or events, personal injury, theft, property damage, transport issues, alcohol consumption, or third-party conduct. Users are responsible for their own decisions, safety, and compliance with local laws. If you feel unsafe or encounter inappropriate behaviour, contact local authorities where appropriate.
9. Third-Party Services
Nyte may integrate with or link to third-party services including maps, ticketing providers, payment processors, social media platforms, and external websites. Nyte is not responsible for third-party content, policies, or services.
10. Intellectual Property
All Nyte branding, logos, graphics, software, and platform content are owned by or licensed to Nyte and are protected by intellectual property laws. You may not copy, modify, redistribute, reverse engineer, or commercially exploit any part of the Platform without written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Nyte and its affiliates are not liable for indirect or consequential losses, loss of profits or data, business interruption, personal injury, user disputes, or reliance on Platform information. The Platform is provided on an "as is" and "as available" basis without warranties of any kind.
12. Termination and Changes
Nyte may suspend or terminate access to the Platform at any time if a user breaches these Terms or engages in harmful behaviour. Nyte may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from the use of Nyte will be subject to the jurisdiction of the courts of Victoria.
Privacy Policy
Nyte collects information you provide, such as name, email address, username, profile information, venue claim details, posts, messages, check-ins, photos, and support requests. Nyte may also collect device, usage, approximate location, and permission-based location information to operate the Platform.
We use this information to provide account access, venue discovery, nearby activity, live maps, social and event recommendations, messaging, moderation, venue tools, analytics, security, support, and product improvement.
Some activity on Nyte is visible to other users, including profile details, posts, check-ins, comments, follows, venue activity, and other social actions you choose to make. Direct messages are intended to be private between participants, subject to safety, security, legal, and moderation requirements.
Nyte may use third-party services such as Supabase, Mapbox, Vercel, payment processors, email providers, analytics tools, and other infrastructure providers. These services may process information on Nyte's behalf. Nyte does not sell personal information.
You can update account information in the Platform, control device location permissions, and request help with privacy or account questions by contacting Nyte. We keep information for as long as needed to provide the Platform, comply with legal obligations, resolve disputes, and enforce our agreements.
